Ownership transfer – Land registry and fees in Southern Cyprus

🏛️ Basic Information
In Southern Cyprus, ownership of a property is confirmed by a Title Deed – an official ownership document issued by the District Land Office.
Without registration at the Land Registry, the transfer is not legally valid, even if the Sales & Purchase Agreement (SPA) has been signed and paid.

The ownership transfer process is called Transfer of Title Deed and is carried out after all contractual and tax obligations of both buyer and seller are fulfilled.


1️⃣ When ownership is transferred

  • After full payment of the purchase price (or installment plan)
  • After paying all taxes (stamp duty, VAT, transfer fee – if applicable)
  • When the developer or seller has issued separate Title Deeds
  • After granting of acquisition permission (Council of Ministers Approval) – for non-EU buyers

The lawyer then submits the transfer application to the District Land Office.


2️⃣ Documents required for the Land Registry
For the ownership transfer, the following documents must be submitted:

  • Sales & Purchase Agreement – registered at the Land Registry within 60 days of signing
  • Proof of payment of the purchase price (bank confirmations / escrow receipt)
  • Seller’s Title Deed
  • Tax clearance certificates (confirming no outstanding taxes on the property)
  • Proof of Stamp Duty and VAT payment
  • Identification documents of buyer and seller
  • For non-EU buyers – approval from Council of Ministers / District Administration

3️⃣ Land Registry – transfer procedure

  • Submission of transfer application at the relevant District Land Office (Larnaca, Limassol, Paphos, Nicosia, Famagusta)
  • Officer checks documents, contract, title, and payment of all fees
  • Buyer pays Transfer Fees (if applicable)
  • New Title Deed is issued in the buyer’s name

⏱️ Typical timeframe:

  • 1–2 months for resale (existing title)
  • 3–6 months for new builds with a new title
  • 6–12 months if the title is still being divided (e.g., apartment project)

💡 If the property was purchased with VAT (new build), transfer fee is not applied.
If purchased without VAT (resale), the reduced rate applies (–50 %).

🔍 Example calculation
Apartment purchased for €300,000 without VAT:

85,000 × 1.5 % = 1,275 €
85,000 × 2.5 % = 2,125 €
130,000 × 4 % = 5,200 €
➡️ Total Transfer Fee = 8,600 €


5️⃣ Stamp Duty
Paid when signing the SPA, before registration at the Land Registry.

💡 Maximum legal cap is approximately €20,000.


6️⃣ Developer / management fees
For new builds, the developer may charge:

  • Administration fee for handover – approx. €300–500
  • Service charge (maintenance of common areas) – depends on project, €30–150/month
  • Insurance and maintenance – recommended for all new properties

7️⃣ Transfer to heirs / gifting

  • Inheritance of property in Cyprus is not subject to inheritance tax
  • For transfer to a family member (gift), 0 % Transfer Fee applies
  • Family relationship must be proven (birth certificate, marriage certificate)

8️⃣ Important notes

  • A registered SPA protects the buyer even if the developer has not yet issued the titles
  • Without registration within 60 days, legal claims may be lost
  • Always check that the developer has paid all taxes and fees before transfer (otherwise the Land Registry may stop the process)
