Tieto transakcie sa riadia<br \/>stanoven\u00fdmi z\u00e1konmi a administrat\u00edvnymi postupmi, ktor\u00e9 zabezpe\u010duj\u00fa transparentnos\u0165 a predv\u00eddate\u013enos\u0165.<br \/>Mnoh\u00ed \u0161t\u00e1tni pr\u00edslu\u0161n\u00edci tret\u00edch kraj\u00edn vr\u00e1tane ob\u010danov E\u00da sa z\u00fa\u010dastnili na tak\u00fdchto transakci\u00e1ch<br \/>bez incidentov, \u010do dokazuje spo\u013eahlivos\u0165 a \u00fa\u010dinnos\u0165 pr\u00e1vnych in\u0161tit\u00faci\u00ed TRNC. <\/li>\n\n\n\n<li>\u00davahy o medzin\u00e1rodnom pr\u00e1ve<br \/>Pod\u013ea v\u0161eobecn\u00fdch z\u00e1sad medzin\u00e1rodn\u00e9ho pr\u00e1va nez\u00e1vis\u00ed platnos\u0165 pr\u00e1vnych \u00fakonov vykonan\u00fdch na \u00fazem\u00ed<br \/>len od stup\u0148a medzin\u00e1rodn\u00e9ho uznania org\u00e1nu vykon\u00e1vaj\u00faceho kontrolu<br \/>nad t\u00fdmto \u00fazem\u00edm. Jednotlivci konaj\u00faci v dobrej viere v pr\u00e1vnom r\u00e1mci de facto org\u00e1nu<br \/>s \u00fa\u010dinnou kontrolou s\u00fa opr\u00e1vnen\u00ed spolieha\u0165 sa na pr\u00e1vne d\u00f4sledky t\u00fdchto \u00fakonov.<br \/>T\u00e1to z\u00e1sada\u0336odr\u00e1\u017ean\u00e1 v judikat\u00fare Medzin\u00e1rodn\u00e9ho s\u00fadneho dvora, \u010dasto ozna\u010dovan\u00e1 ako<br \/>doktr\u00edna Nam\u00edbie\u0336a posilnen\u00e1 medzin\u00e1rodn\u00fdm pr\u00e1vom v oblasti \u013eudsk\u00fdch pr\u00e1v, sa sna\u017e\u00ed chr\u00e1ni\u0165<br \/>legit\u00edmne o\u010dak\u00e1vania a pr\u00e1va s\u00fakromn\u00fdch os\u00f4b, a to aj v pr\u00edpade, ke\u010f je politick\u00fd status<br \/>\u00fazemia sporn\u00fd.<br \/>Medzin\u00e1rodn\u00e9 pr\u00e1vo nevy\u017eaduje, aby sa transakcie vykonan\u00e9 pod\u013ea pr\u00e1vneho poriadku neuznan\u00e9ho<br \/>subjektu pova\u017eovali za neplatn\u00e9, najm\u00e4 ak nestrann\u00e9 medzin\u00e1rodn\u00e9 in\u0161tit\u00facie uzn\u00e1vaj\u00fa<br \/>funk\u010dnos\u0165 pr\u00edslu\u0161n\u00fdch mechanizmov. Okrem toho ofici\u00e1lne dokumenty vydan\u00e9 cypersk\u00fdmi tureck\u00fdmi<br \/>org\u00e1nmi, ako s\u00fa napr\u00edklad ob\u010dianske preukazy, s\u00fa be\u017ene akceptovan\u00e9 &#8222;Cyperskou republikou&#8220;<br \/>(\u010falej aj ako gr\u00e9cka cypersk\u00e1 spr\u00e1va alebo ju\u017en\u00fd Cyprus) na<br \/>administrat\u00edvne \u00fa\u010dely.  <\/li>\n\n\n\n<li>Uznanie Eur\u00f3pskym s\u00fadom pre \u013eudsk\u00e9 pr\u00e1va (ES\u013dP)<br \/>Eur\u00f3psky s\u00fad pre \u013eudsk\u00e9<br \/>pr\u00e1va vo svojom prelomovom rozsudku Demopoulos a in\u00ed proti Turecku (2010) uznal Komisiu pre nehnute\u013enos\u0165 (IPC) zriaden\u00fa pod\u013ea pr\u00e1va TRNC ako<br \/>\u00fa\u010dinn\u00fd vn\u00fatro\u0161t\u00e1tny prostriedok n\u00e1pravy. S\u00fad rozhodol, \u017ee \u017eiadatelia musia vy\u010derpa\u0165 postupy IPC pred t\u00fdm, ako sa<br \/>obr\u00e1tia na medzin\u00e1rodn\u00e9 org\u00e1ny. T\u00fdmto uznan\u00edm sa potvrdzuje pr\u00e1vna sp\u00f4sobilos\u0165 TRNC<br \/>rie\u0161i\u0165 spory o nehnute\u013enosti prostredn\u00edctvom funguj\u00faceho mechanizmu schv\u00e1len\u00e9ho medzin\u00e1rodn\u00fdm s\u00fadnym<br \/>org\u00e1nom.  <\/li>\n\n\n\n<li>Odkazy na n\u00e1mietky gr\u00e9ckych Cyper\u010danov<br \/>V s\u00favislosti s n\u00e1mietkami proti nehnute\u013enostiam alebo obchodn\u00fdm aktivit\u00e1m na severnom Cypre sa \u010dasto uv\u00e1dzaj\u00fa rezol\u00facie Bezpe\u010dnostnej rady OSN<br \/>541 (1983) a 550 (1984). Tieto rezol\u00facie s\u00fa v\u0161ak politick\u00fdmi<br \/>vyhl\u00e1seniami o \u0161tat\u00fate TRNC a neukladaj\u00fa pr\u00e1vne z\u00e1kazy s\u00fakromn\u00fdch<br \/>komer\u010dn\u00fdch alebo nehnute\u013enost\u00ed aktiv\u00edt v oblastiach pod spr\u00e1vou TRNC. Nezru\u0161uj\u00fa<br \/>pr\u00e1va komunity cypersk\u00fdch Turkov ani zahrani\u010dn\u00fdch investorov p\u00f4sobiacich v r\u00e1mci<br \/>z\u00e1konn\u00e9ho r\u00e1mca TRNC.  <\/li>\n\n\n\n<li>Jurisdik\u010dn\u00e9 n\u00e1roky<br \/>Tvrdenia &#8222;Cyperskej republiky&#8220;\/cyperskej gr\u00e9ckej administrat\u00edvy, \u017ee jednotlivci, ktor\u00ed vykon\u00e1vaj\u00fa \u010dinnosti<br \/>v oblasti nehnute\u013enost\u00ed na Severnom Cypre, m\u00f4\u017eu by\u0165 trestne zodpovedn\u00ed pod\u013ea juhocypersk\u00e9ho pr\u00e1va<br \/>, nemaj\u00fa oporu v medzin\u00e1rodnej judikat\u00fare. Ke\u010f\u017ee ju\u017en\u00fd Cyprus nevykon\u00e1va \u00fa\u010dinn\u00fa kontrolu na<br \/>severe, jeho jurisdikcia sa nem\u00f4\u017ee vz\u0165ahova\u0165 na \u010diny, ktor\u00e9 sa tam vykon\u00e1vaj\u00fa. Extrateritori\u00e1lne uplat\u0148ovanie<br \/>trestn\u00e9ho pr\u00e1va v tejto s\u00favislosti by bolo v rozpore so z\u00e1kladn\u00fdmi z\u00e1sadami zvrchovanosti a<br \/>podkop\u00e1valo by s\u00fadr\u017enos\u0165 medzin\u00e1rodn\u00e9ho pr\u00e1vneho poriadku.  <\/li>\n\n\n\n<li>Pr\u00e1vo E\u00da a protokol \u010d. 10<br \/>Protokol \u010d. 10 Aktu o prist\u00fapen\u00ed Cypru k Eur\u00f3pskej \u00fanii z roku 2003 stanovuje, \u017ee uplat\u0148ovanie acquis communautaire<br \/>sa pozastavuje v oblastiach, v ktor\u00fdch vl\u00e1da &#8222;Cyperskej republiky<br \/>&#8222;\/gr\u00e9cka cypersk\u00e1 spr\u00e1va nevykon\u00e1va \u00fa\u010dinn\u00fa kontrolu. V \u010dl\u00e1nku 1 ods. 2 sa v\u00fdslovne<br \/>uv\u00e1dza:<br \/>&#8222;Pozastavenie uplat\u0148ovania acquis nebr\u00e1ni opatreniam s cie\u013eom<br \/>podpori\u0165 hospod\u00e1rsky rozvoj [Severn\u00e9ho Cypru].&#8220;<br \/>Toto ustanovenie jednozna\u010dne umo\u017e\u0148uje\u0336a dokonca podporuje\u0336z\u00e1konn\u00fa hospod\u00e1rsku anga\u017eovanos\u0165 na Severnom<br \/>Cypre. Transakcie s nehnute\u013enos\u0165ami uskuto\u010d\u0148ovan\u00e9 pod\u013ea pr\u00e1vnych predpisov TRNC a uznan\u00fdch mechanizmov, ako je<br \/>ZPP, preto nie s\u00fa v rozpore s pr\u00e1vom E\u00da. Naopak, s\u00fa v s\u00falade s cie\u013emi E\u00da<br \/>podporova\u0165 mier, stabilitu a soci\u00e1lno-ekonomick\u00fd rozvoj na celom ostrove.   <\/li>\n\n\n\n<li><br \/>Zav\u00e1dzaj\u00face tvrdenia a ich \u00fa\u010dinky<br \/>Varovania vydan\u00e9 juhocypersk\u00fdmi org\u00e1nmi, ktor\u00e9 nazna\u010duj\u00fa, \u017ee cudz\u00ed \u0161t\u00e1tni pr\u00edslu\u0161n\u00edci m\u00f4\u017eu \u010deli\u0165 pr\u00e1vnym d\u00f4sledkom v pr\u00edpade k\u00fapy alebo v\u00fdstavby nehnute\u013enost\u00ed na Severnom Cypre, s\u00fa zav\u00e1dzaj\u00face.<br \/>dokumenty vydan\u00e9 TRNC, ktor\u00e9 nazna\u010duj\u00fa, \u017ee cudz\u00ed \u0161t\u00e1tni pr\u00edslu\u0161n\u00edci m\u00f4\u017eu \u010deli\u0165 pr\u00e1vnym d\u00f4sledkom v pr\u00edpade k\u00fapy alebo v\u00fdstavby nehnute\u013enost\u00ed na Severnom Cypre, s\u00fa zav\u00e1dzaj\u00face.<br \/>Transakcie uskuto\u010dnen\u00e9 v s\u00falade s pr\u00e1vnymi postupmi TRNC a s Tak\u00e9to varovania zbyto\u010dne vyvol\u00e1vaj\u00fa strach<br \/>medzi investormi, odr\u00e1dzaj\u00fa od anga\u017eovanosti medzi komunitami a br\u00e1nia \u00fasiliu zameran\u00e9mu na<br \/>usmierovanie a spolupr\u00e1cu. <\/li>\n\n\n\n<li><br \/>Ned\u00e1vne franc\u00fazske s\u00fadne rozhodnutie o eur\u00f3pskom zatyka\u010di<br \/>(2025)<br \/>V\u00fdznamn\u00fd v\u00fdvoj nastal v decembri 2025, ke\u010f vy\u0161etrovacia komora (Chambre de l&#8217;instruction) odvolacieho s\u00fadu v Aix-en-Provence vo Franc\u00fazsku<br \/>presk\u00famala eur\u00f3psky zatyka\u010d vydan\u00fd &#8222;Cyperskou republikou&#8220;\/Gr\u00e9ckou cyperskou<br \/>spr\u00e1vou t\u00fdkaj\u00faci sa \u00fadajn\u00fdch stavebn\u00fdch \u010dinnost\u00ed na severnom Cypre. S\u00fad kon\u0161tatoval, \u017ee<br \/>tak\u00e9to pr\u00e1vne n\u00e1stroje nemo\u017eno pou\u017e\u00edva\u0165 ako roz\u0161\u00edrenie politick\u00fdch cie\u013eov alebo sporov o zvrchovanos\u0165.<br \/>Zd\u00f4raznil, \u017ee k predmetn\u00fdm \u010dinnostiam do\u0161lo v regi\u00f3ne, v ktorom je pozastaven\u00e9 uplat\u0148ovanie acquis E\u00da<br \/>, a dospel k z\u00e1veru, \u017ee domnienka trestnej pr\u00e1vomoci gr\u00e9cko-cyperskej administrat\u00edvy nem\u00f4\u017ee by\u0165<br \/>akceptovan\u00e1 automaticky. Toto rozhodnutie odr\u00e1\u017ea z\u00e1v\u00e4zok franc\u00fazskeho s\u00fadnictva uplat\u0148ova\u0165<br \/>pr\u00e1vo s oh\u013eadom na skutkov\u00fa realitu a z\u00e1rove\u0148 dodr\u017eiava\u0165 nestrannos\u0165 a z\u00e1sady, z ktor\u00fdch vych\u00e1dza<br \/>r\u00e1mec eur\u00f3pskeho zat\u00fdkacieho rozkazu.<br \/>Toto rozhodnutie predstavuje d\u00f4le\u017eit\u00fd m\u00ed\u013enik pre cypersk\u00fdch Turkov. T\u00fdm, \u017ee s\u00fad zabr\u00e1nil tomu, aby<br \/>osoby boli vystaven\u00e9 politicky motivovan\u00e9mu cezhrani\u010dn\u00e9mu trestn\u00e9mu konaniu,<br \/>uznal \u017eivotn\u00fa realitu komunity, ktorej perspekt\u00edvy boli v minulosti marginalizovan\u00e9<br \/>. Okrem pr\u00e1vnych d\u00f4sledkov rozsudok posil\u0148uje pocit pr\u00e1vnej istoty pre<br \/>osoby s pobytom a podnikan\u00edm na Severnom Cypre, zvy\u0161uje d\u00f4veru verejnosti a<br \/>symbolicky, ale v\u00fdznamne prispieva k \u0161ir\u0161iemu medzin\u00e1rodn\u00e9mu vn\u00edmaniu a<br \/>legitimite komunity cypersk\u00fdch Turkov.    <\/li>\n\n\n\n<li>Z\u00e1ver<br \/>Transakcie s nehnute\u013enos\u0165ami a invest\u00edcie v TRNC sa uskuto\u010d\u0148uj\u00fa v r\u00e1mci koherentn\u00e9ho, funk\u010dn\u00e9ho a<br \/>predv\u00eddate\u013en\u00e9ho pr\u00e1vneho r\u00e1mca. Cudz\u00ed \u0161t\u00e1tni pr\u00edslu\u0161n\u00edci sa m\u00f4\u017eu do tak\u00fdchto transakci\u00ed zapoji\u0165 s d\u00f4verou,<br \/>podporovanou miestnou pr\u00e1vnou ochranou a mechanizmami uzn\u00e1van\u00fdmi na medzin\u00e1rodnej \u00farovni.<br \/>\u00dasilie by sa preto nemalo zameriava\u0165 na odr\u00e1dzanie od legit\u00edmnej hospod\u00e1rskej \u010dinnosti, ale na podporu<br \/>dial\u00f3gu, d\u00f4very a hospod\u00e1rskej spolupr\u00e1ce v prospech v\u0161etk\u00fdch komun\u00edt na ostrove. <\/li>\n<\/ol>\n\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div id=\"qaef-24631\" class=\"qe-faq-toggle \">\n\t\t\t<div class=\"qe-toggle-title\">\n\t\t\t\t<h4>\n\t\t\t\t\t<i class=\"fa fa-minus-circle\"><\/i> Ak\u00e1 je da\u0148 z pren\u00e1jmu nehnute\u013enost\u00ed na Severnom a Ju\u017enom Cypre?\t\t\t\t<\/h4>\n\t\t\t<\/div>\n\t\t\t<div class=\"qe-toggle-content\">\n\t\t\t\t\n<p class=\"wp-block-paragraph\"><strong>  Ju\u017en\u00fd Cyprus (E\u00da)<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Pr\u00edjmy z pren\u00e1jmu sa zda\u0148uj\u00fa progres\u00edvnou sadzbou dane z pr\u00edjmu.<\/p>\n\n<p class=\"wp-block-paragraph\">Sadzby pre jednotlivcov:<\/p>\n\n<p class=\"wp-block-paragraph\">a\u017e do v\u00fd\u0161ky pribli\u017ene 19 500 EUR ro\u010dne: 0% <\/p>\n\n<p class=\"wp-block-paragraph\">potom 20 % &#8211; 35 % v z\u00e1vislosti od pr\u00edjmu<\/p>\n\n<p class=\"wp-block-paragraph\">Okrem toho sa plat\u00ed aj pr\u00edspevok na obranu (SDC):<\/p>\n\n<p class=\"wp-block-paragraph\">pribli\u017ene 2,25 % z pr\u00edjmu z pren\u00e1jmu <\/p>\n\n<p class=\"wp-block-paragraph\">Povinnosti m\u00f4\u017eu vznikn\u00fa\u0165 aj v pr\u00edpade kr\u00e1tkodob\u00fdch pren\u00e1jmov (Airbnb):<\/p>\n\n<p class=\"wp-block-paragraph\">registr\u00e1cia,<\/p>\n\n<p class=\"wp-block-paragraph\">v niektor\u00fdch pr\u00edpadoch DPH (19 %), ak ide o podnikate\u013esk\u00fa \u010dinnos\u0165.<\/p>\n\n<p class=\"wp-block-paragraph\">\u2705 Efekt\u00edvne zdanenie sa \u010dasto pohybuje od pribli\u017ene 10 do 25 % v z\u00e1vislosti od pr\u00edjmov a n\u00e1kladov. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Severn\u00fd Cyprus (TRNC)<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Da\u0148 z pren\u00e1jmu je jednoduch\u0161ia a ni\u017e\u0161ia.<\/p>\n\n<p class=\"wp-block-paragraph\">Be\u017ene platen\u00e9:<\/p>\n\n<p class=\"wp-block-paragraph\">10 % hrub\u00e9ho pr\u00edjmu z pren\u00e1jmu alebo<\/p>\n\n<p class=\"wp-block-paragraph\">pr\u00edpadne sadzba pod\u013ea da\u0148ov\u00e9ho \u00faradu v ro\u010dnom priznan\u00ed<\/p>\n\n<p class=\"wp-block-paragraph\">Pri \u0161tandardn\u00fdch dlhodob\u00fdch pren\u00e1jmoch sa DPH zvy\u010dajne neplat\u00ed.<\/p>\n\n<p class=\"wp-block-paragraph\">Kr\u00e1tkodob\u00e9 pren\u00e1jmy (turistick\u00e9) m\u00f4\u017eu ma\u0165:<\/p>\n\n<p class=\"wp-block-paragraph\">vy\u0161\u0161iu sadzbu alebo<\/p>\n\n<p class=\"wp-block-paragraph\">povinnos\u0165 registr\u00e1cie na miestnom \u00farade.<\/p>\n\n<p class=\"wp-block-paragraph\">\u2705 V praxi investori naj\u010dastej\u0161ie o\u010dak\u00e1vaj\u00fa da\u0148 vo v\u00fd\u0161ke pribli\u017ene 10 %.<\/p>\n\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div id=\"qaef-24625\" class=\"qe-faq-toggle \">\n\t\t\t<div class=\"qe-toggle-title\">\n\t\t\t\t<h4>\n\t\t\t\t\t<i class=\"fa fa-minus-circle\"><\/i> \u010co sa stane s nehnute\u013enos\u0165ou po smrti vlastn\u00edka ?\t\t\t\t<\/h4>\n\t\t\t<\/div>\n\t\t\t<div class=\"qe-toggle-content\">\n\t\t\t\t\n<p class=\"wp-block-paragraph\">Ak existuje z\u00e1vet, nehnute\u013enos\u0165 sa rozdel\u00ed pod\u013ea neho.<\/p>\n\n<p class=\"wp-block-paragraph\">Ak neexistuje z\u00e1vet, nehnute\u013enos\u0165 sa ded\u00ed pod\u013ea z\u00e1kona (deti, man\u017eel\/man\u017eelka).<\/p>\n\n<p class=\"wp-block-paragraph\">\u0160t\u00e1t ded\u00ed len v pr\u00edpade, \u017ee neexistuj\u00fa z\u00e1konn\u00ed dedi\u010dia.<\/p>\n\n<p class=\"wp-block-paragraph\">Ak je dedi\u010dom napr\u00edklad jedin\u00fd syn, dostane 100 % nehnute\u013enosti.<\/p>\n\n<p class=\"wp-block-paragraph\">\ud83d\udc49 Odpor\u00fa\u010da sa ma\u0165 z\u00e1vet, ktor\u00fd v\u00fdrazne zjednodu\u0161\u00ed a ur\u00fdchli proces dedenia.<\/p>\n\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div id=\"qaef-17820\" class=\"qe-faq-toggle \">\n\t\t\t<div class=\"qe-toggle-title\">\n\t\t\t\t<h4>\n\t\t\t\t\t<i class=\"fa fa-minus-circle\"><\/i> Povolenie na n\u00e1kup\t\t\t\t<\/h4>\n\t\t\t<\/div>\n\t\t\t<div class=\"qe-toggle-content\">\n\t\t\t\t\n<p class=\"wp-block-paragraph\">Zahrani\u010dn\u00fd kupuj\u00faci nehnute\u013enosti na Severnom Cypre mus\u00ed poda\u0165 \u017eiados\u0165 o povolenie na k\u00fapu.
