Slov\u00e1k, \u010cech, Ma\u010far) se m\u016f\u017ee rozhodnout, zda se jeho majetek na Kypru bude d\u011bdit podle <strong>kypersk\u00e9ho pr\u00e1va<\/strong> nebo podle <strong>pr\u00e1va jeho domovsk\u00e9 zem\u011b<\/strong>.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\">1\ufe0f\u20e3 Kdo m\u016f\u017ee vlastnit nemovitost na Kypru<\/h2>\n\n<p class=\"wp-block-paragraph\">Ob\u010dan\u00e9 EU mohou vlastnit nemovitosti bez omezen\u00ed &#8211; byty, domy, pozemky a v\u00edce bytov\u00fdch jednotek.<\/p>\n\n<p class=\"wp-block-paragraph\">Ob\u010dan\u00e9 t\u0159et\u00edch zem\u00ed pot\u0159ebuj\u00ed souhlas <strong>Rady ministr\u016f<\/strong>, av\u0161ak v p\u0159\u00edpad\u011b d\u011bdictv\u00ed p\u0159ech\u00e1z\u00ed vlastnictv\u00ed na d\u011bdice automaticky bez nutnosti pod\u00e1vat samostatnou \u017e\u00e1dost.<\/p>\n\n<p class=\"wp-block-paragraph\">\ud83d\udca1 Vlastnick\u00e9 pr\u00e1vo k nemovitosti p\u0159ech\u00e1z\u00ed na d\u011bdice po smrti vlastn\u00edka, a to i v p\u0159\u00edpad\u011b, \u017ee byla nemovitost spojena s povolen\u00edm k pobytu na z\u00e1klad\u011b investic (PRP) &#8211; d\u011bdic zd\u011bd\u00ed nemovitost spolu se v\u0161emi souvisej\u00edc\u00edmi pr\u00e1vy.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\">2\ufe0f\u20e3 D\u011bdick\u00e9 pr\u00e1vo podle kypersk\u00fdch pr\u00e1vn\u00edch p\u0159edpis\u016f<\/h2>\n\n<p class=\"wp-block-paragraph\">Pokud si osoba nezvol\u00ed pr\u00e1vn\u00ed syst\u00e9m (nap\u0159. nem\u00e1 z\u00e1v\u011b\u0165), plat\u00ed <strong>kypersk\u00e9 d\u011bdick\u00e9 pr\u00e1vo<\/strong>, kter\u00e9 zahrnuje <strong>nucen\u00e9 d\u011bdictv\u00ed<\/strong> &#8211; povinn\u00e9 pod\u00edly pro bl\u00edzk\u00e9 p\u0159\u00edbuzn\u00e9.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Rozd\u011blen\u00ed poz\u016fstalosti podle kypersk\u00e9ho pr\u00e1va:<\/strong><\/p>\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Rodinn\u00fd stav<\/th><th>Pod\u00edl poz\u016fstal\u00e9ho man\u017eela\/man\u017eelky<\/th><th>Pod\u00edl d\u011bt\u00ed \/ rodi\u010d\u016f<\/th><\/tr><\/thead><tbody><tr><td>Man\u017eel\/ka + d\u011bti<\/td><td>25 % man\u017eel\u016f<\/td><td>75 % rozd\u011bleno mezi d\u011bti<\/td><\/tr><tr><td>Man\u017eel\/ka + rodi\u010de (bez d\u011bt\u00ed)<\/td><td>50 % man\u017eel\/ka<\/td><td>50 % rodi\u010d\u016f<\/td><\/tr><tr><td>\u017d\u00e1dn\u00e1 rodina<\/td><td>Cel\u00e1 poz\u016fstalost p\u0159ech\u00e1z\u00ed na st\u00e1t<\/td><td>\u2013<\/td><\/tr><\/tbody><\/table><\/figure>\n\n<p class=\"wp-block-paragraph\">\ud83d\udca1 \u010c\u00e1st poz\u016fstalosti lze odk\u00e1zat voln\u011b (disponibiln\u00ed \u010d\u00e1st), zat\u00edmco zbytek se d\u011bd\u00ed povinn\u011b ze z\u00e1kona.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\">3\ufe0f\u20e3 Posledn\u00ed v\u016fle<\/h2>\n\n<p class=\"wp-block-paragraph\">Na Kypru m\u016f\u017ee ka\u017ed\u00fd obyvatel nebo vlastn\u00edk nemovitosti sepsat <strong>z\u00e1v\u011b\u0165<\/strong>, v n\u00ed\u017e ur\u010d\u00ed, kdo bude d\u011bdit jeho majetek na Kypru.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Mo\u017enosti:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Z\u00e1v\u011b\u0165 se m\u016f\u017ee vztahovat pouze na majetek na Kypru, nebo<\/li>\n\n\n\n<li>Cel\u00fd majetek podle kypersk\u00e9ho pr\u00e1va.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>Po\u017eadavky:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Mus\u00ed b\u00fdt p\u00edsemn\u00e1, podepsan\u00e1 a potvrzen\u00e1 dv\u011bma osobami.<\/li>\n\n\n\n<li>Doporu\u010dujeme ulo\u017eit origin\u00e1l u pr\u00e1vn\u00edka nebo not\u00e1\u0159e.<\/li>\n\n\n\n<li>Z\u00e1v\u011b\u0165 lze kdykoli zm\u011bnit nebo odvolat.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">\ud83d\udca1 Kypersk\u00e1 z\u00e1v\u011b\u0165 m\u016f\u017ee b\u00fdt seps\u00e1na v angli\u010dtin\u011b a m\u016f\u017ee obsahovat odkaz, \u017ee d\u011bdictv\u00ed se \u0159\u00edd\u00ed pr\u00e1vem domovsk\u00e9 zem\u011b (nap\u0159. Slovensk\u00e9 republiky) &#8211; v souladu s <strong>na\u0159\u00edzen\u00edm EU \u010d. 650\/2012<\/strong>.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\">4\ufe0f\u20e3 P\u0159evod majetku po smrti<\/h2>\n\n<p class=\"wp-block-paragraph\">Po smrti majitele:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Pr\u00e1vn\u00edk p\u0159edlo\u017e\u00ed okresn\u00edmu pozemkov\u00e9mu \u00fa\u0159adu <strong>\u00famrtn\u00ed list<\/strong> a kopii <strong>z\u00e1v\u011bti<\/strong>.<\/li>\n\n\n\n<li>\u00da\u0159ad vyd\u00e1 <strong>potvrzen\u00ed o p\u0159evodu vlastnictv\u00ed.<\/strong><\/li>\n\n\n\n<li>D\u011bdicov\u00e9 mohou p\u0159ev\u00e9st <strong>list vlastnictv\u00ed<\/strong> na sv\u00e9 jm\u00e9no nebo nemovitost prodat.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>Po\u017eadovan\u00e9 dokumenty:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>P\u016fvodn\u00ed titul listiny<\/li>\n\n\n\n<li>\u00damrtn\u00ed list (apostilovan\u00fd a p\u0159elo\u017een\u00fd)<\/li>\n\n\n\n<li>Z\u00e1v\u011b\u0165 nebo soudn\u00ed rozhodnut\u00ed<\/li>\n\n\n\n<li>Ov\u011b\u0159en\u00e9 pr\u016fkazy toto\u017enosti d\u011bdic\u016f<\/li>\n\n\n\n<li>Osv\u011bd\u010den\u00ed o z\u00fa\u010dtov\u00e1n\u00ed dan\u00ed &#8211; potvrzen\u00ed o zaplacen\u00ed v\u0161ech dan\u00ed a poplatk\u016f.<\/li>\n<\/ul>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\">5\ufe0f\u20e3 D\u011bdick\u00e1 da\u0148<\/h2>\n\n<p class=\"wp-block-paragraph\">\ud83d\udcb6 <strong>Na Kypru neexistuje d\u011bdick\u00e1 da\u0148<\/strong>. To je jedna z nejv\u011bt\u0161\u00edch v\u00fdhod pro investory. <\/p>\n\n<p class=\"wp-block-paragraph\">Od roku 2000 je d\u011bdick\u00e1 da\u0148 zcela zru\u0161ena &#8211; p\u0159i p\u0159evodu majetku na d\u011bdice se neplat\u00ed \u017e\u00e1dn\u00e9 poplatky ani dan\u011b.<\/p>\n\n<p class=\"wp-block-paragraph\">D\u011bdicov\u00e9 jsou odpov\u011bdn\u00ed pouze za:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Spr\u00e1vn\u00ed poplatky v katastru nemovitost\u00ed (cca 50-100 EUR)<\/li>\n\n\n\n<li>Pr\u00e1vn\u00ed poplatky za p\u0159evod vlastnick\u00e9ho pr\u00e1va (cca 300 &#8211; 500 EUR).<\/li>\n<\/ul>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\">6\ufe0f\u20e3 D\u011bdictv\u00ed pro ciz\u00ed st\u00e1tn\u00ed p\u0159\u00edslu\u0161n\u00edky (expaty)<\/h2>\n\n<p class=\"wp-block-paragraph\">Pokud je vlastn\u00edk nemovitosti z jin\u00e9 zem\u011b EU:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Mohou si zvolit pr\u00e1vn\u00ed syst\u00e9m sv\u00e9 domovsk\u00e9 zem\u011b (nap\u0159. slovensk\u00e9 nebo \u010desk\u00e9 d\u011bdick\u00e9 pr\u00e1vo), nebo<\/li>\n\n\n\n<li>Mohou si ponechat <strong>kypersk\u00e9 pr\u00e1vo<\/strong>, pokud maj\u00ed bydli\u0161t\u011b na Kypru a povolen\u00ed k trval\u00e9mu pobytu.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">\ud83d\udca1 Doporu\u010dujeme tuto volbu uv\u00e9st v z\u00e1v\u011bti, jinak se d\u011bdictv\u00ed bude \u0159\u00eddit m\u00edstn\u00edm kypersk\u00fdm pr\u00e1vem.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\">7\ufe0f\u20e3 Vlastnictv\u00ed majetku po \u00famrt\u00ed partnera<\/h2>\n\n<ul class=\"wp-block-list\">\n<li>Pokud <strong>je list vlastnictv\u00ed zaps\u00e1n na oba man\u017eele<\/strong>, poz\u016fstal\u00fd partner se automaticky st\u00e1v\u00e1 <strong>50% spoluvlastn\u00edkem<\/strong>.<\/li>\n\n\n\n<li>Zb\u00fdvaj\u00edc\u00edch 50 % se p\u0159evede na <strong>opr\u00e1vn\u011bn\u00e9 d\u011bdice<\/strong> zem\u0159el\u00e9ho.<\/li>\n\n\n\n<li>Pokud <strong>je list vlastnictv\u00ed zaps\u00e1n pouze na jednoho z man\u017eel\u016f<\/strong>, vy\u0159\u00edd\u00ed <strong>d\u011bdick\u00e9 \u0159\u00edzen\u00ed<\/strong> a p\u0159evede majetek na <strong>opr\u00e1vn\u011bn\u00e9 d\u011bdice<\/strong> pr\u00e1vn\u00edk.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>\u2696\ufe0f Z\u00e1kladn\u00ed informaceJi\u017en\u00ed Kypr funguje podle pr\u00e1vn\u00edho syst\u00e9mu Common Law, kter\u00fd se li\u0161\u00ed od slovensk\u00e9ho nebo \u010desk\u00e9ho d\u011bdick\u00e9ho pr\u00e1va.
