nemovitosti &#8211; a\u0165 u\u017e se jedn\u00e1 o pozemek, byt nebo d\u016fm.<\/p>\n\n<p class=\"wp-block-paragraph\">V praxi se jedn\u00e1 o nejd\u016fle\u017eit\u011bj\u0161\u00ed dokument, kter\u00fd prokazuje, \u017ee nemovitost pat\u0159\u00ed konkr\u00e9tn\u00ed osob\u011b.<br\/>Kdo je zaps\u00e1n na listu vlastnictv\u00ed, je jedin\u00fdm pr\u00e1vn\u00edm obdr\u017e\u00ed <strong>kupn\u00ed smlouvu<\/strong> registrovanou v katastru nemovitost\u00ed &#8211;<br\/>teprve pozd\u011bji, po dokon\u010den\u00ed projektu, obdr\u017e\u00ed individu\u00e1ln\u00ed <strong>list vlastnictv\u00ed<\/strong>.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<p class=\"wp-block-paragraph\">2\ufe0f\u20e3 <strong>Kdy se vyd\u00e1v\u00e1 nab\u00fdvac\u00ed titul<\/strong><br\/>Katastr nemovitost\u00ed vyd\u00e1v\u00e1 individu\u00e1ln\u00ed nab\u00fdvac\u00ed titul a\u017e po dokon\u010den\u00ed projektu a jeho kolaudaci<strong>(Osv\u011bd\u010den\u00ed o kolaudaci)<\/strong>.<br\/>Tento proces zahrnuje:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Dokon\u010den\u00ed stavby,<\/li>\n\n\n\n<li>Kontrola org\u00e1ny a vyd\u00e1n\u00ed <strong>osv\u011bd\u010den\u00ed o schv\u00e1len\u00ed<\/strong>,<\/li>\n\n\n\n<li>Rozd\u011blen\u00ed pozemku na samostatn\u00e9 jednotky,<\/li>\n\n\n\n<li>Vyd\u00e1n\u00ed <strong>samostatn\u00fdch listin o vlastnictv\u00ed pro<\/strong> ka\u017ed\u00fd byt nebo d\u016fm.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">\u23f1\ufe0f Tento proces m\u016f\u017ee trvat <strong>6 a\u017e 24 m\u011bs\u00edc\u016f<\/strong> po dokon\u010den\u00ed projektu.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<p class=\"wp-block-paragraph\">3\ufe0f\u20e3 <strong>Koup\u011b nemovitosti bez vydan\u00e9ho vlastnick\u00e9ho titulu<\/strong><br\/>Na Kypru je b\u011b\u017en\u00e9 koupit nemovitost <strong>p\u0159ed vyd\u00e1n\u00edm vlastnick\u00e9ho titulu<\/strong> (tzv. off-plan nebo new development).<br\/>V tomto p\u0159\u00edpad\u011b kupuj\u00edc\u00ed podep\u00ed\u0161e <strong>kupn\u00ed smlouvu<\/strong>, kter\u00e1 je registrov\u00e1na v katastru nemovitost\u00ed a chr\u00e1n\u00ed vlastnick\u00e1 pr\u00e1va kupuj\u00edc\u00edho a\u017e do vyd\u00e1n\u00ed vlastnick\u00e9ho titulu.<\/p>\n\n<p class=\"wp-block-paragraph\">\ud83d\udcdc Registrac\u00ed smlouvy z\u00edsk\u00e1 kupuj\u00edc\u00ed <strong>pr\u00e1vo na konkr\u00e9tn\u00ed pln\u011bn\u00ed<\/strong> &#8211;<br\/>pr\u00e1vn\u00ed ochranu, kter\u00e1 zaji\u0161\u0165uje, \u017ee developer nem\u016f\u017ee nemovitost prodat nikomu jin\u00e9mu nebo ji zastavit.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<p class=\"wp-block-paragraph\">4\ufe0f\u20e3 <strong>Jak zkontrolovat, zda byl k projektu vyd\u00e1n nab\u00fdvac\u00ed titul<\/strong><br\/>Pr\u00e1vn\u00edk kupuj\u00edc\u00edho si m\u016f\u017ee ov\u011b\u0159it stav nab\u00fdvac\u00edho titulu p\u0159\u00edmo na <strong>Odboru pozemk\u016f a geod\u00e9zie<\/strong> pomoc\u00ed \u010d\u00edsla parcely.<br\/>Zkontroluj\u00ed:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Zda existuje individu\u00e1ln\u00ed list vlastnictv\u00ed,<\/li>\n\n\n\n<li>Zda je pozemek bez zat\u00ed\u017een\u00ed (hypot\u00e9ky, z\u00e1stavn\u00ed pr\u00e1va, spory),<\/li>\n\n\n\n<li>zda byla vyd\u00e1na v\u0161echna povolen\u00ed,<\/li>\n\n\n\n<li>Pokud ne, v jak\u00e9 f\u00e1zi se proces vyd\u00e1v\u00e1n\u00ed nach\u00e1z\u00ed.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">\ud83d\udca1 Seri\u00f3zn\u00ed develope\u0159i ve sv\u00fdch nab\u00eddk\u00e1ch zve\u0159ej\u0148uj\u00ed stav vlastnick\u00fdch pr\u00e1v &#8211;<br\/>nap\u0159. &#8222;K dispozici jsou samostatn\u00e9 listy vlastnictv\u00ed&#8220; nebo &#8222;V procesu d\u011blen\u00ed&#8220;.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<p class=\"wp-block-paragraph\">5\ufe0f\u20e3 <strong>P\u0159evod vlastnick\u00e9ho pr\u00e1va<\/strong><br\/>Po vyd\u00e1n\u00ed vlastnick\u00e9ho pr\u00e1va m\u016f\u017ee developer p\u0159ev\u00e9st vlastnictv\u00ed na kupuj\u00edc\u00edho:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Advok\u00e1t pod\u00e1 <strong>\u017e\u00e1dost o p\u0159evod<\/strong>,<\/li>\n\n\n\n<li>Kupuj\u00edc\u00ed hrad\u00ed <strong>poplatek za p\u0159evod<\/strong> (pokud se na n\u011bj vztahuje),<\/li>\n\n\n\n<li>Katastr nemovitost\u00ed vyd\u00e1 nov\u00fd <strong>list vlastnictv\u00ed na<\/strong> jm\u00e9no kupuj\u00edc\u00edho.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Po tomto kroku se kupuj\u00edc\u00ed st\u00e1v\u00e1 ofici\u00e1ln\u00edm vlastn\u00edkem a nemovitost m\u016f\u017ee b\u00fdt:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>prod\u00e1no,<\/li>\n\n\n\n<li>obdarovan\u00fd,<\/li>\n\n\n\n<li>zastaven\u00e9,<\/li>\n\n\n\n<li>d\u011bd\u00ed se bez omezen\u00ed.<\/li>\n<\/ul>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<p class=\"wp-block-paragraph\">6\ufe0f\u20e3 <strong>Rizika p\u0159i koupi bez vydan\u00fdch titul\u016f<\/strong><br\/>\u26a0\ufe0f Developer je\u0161t\u011b nemus\u00ed z\u00edskat v\u0161echna povolen\u00ed.<br\/>\u26a0\ufe0f Projekt m\u016f\u017ee b\u00fdt financov\u00e1n bankovn\u00edm \u00fav\u011brem (hypot\u00e9kou nebo z\u00e1stavn\u00edm pr\u00e1vem).<br\/>\u26a0\ufe0f Zpo\u017ed\u011bn\u00ed p\u0159i vyd\u00e1v\u00e1n\u00ed nab\u00fdvac\u00edch titul\u016f je b\u011b\u017en\u00e9 &#8211; obvykle 1-2 roky po dokon\u010den\u00ed.<br\/>\u26a0\ufe0f N\u011bkte\u0159\u00ed kupuj\u00edc\u00ed ne\u010dekali na nab\u00fdvac\u00ed titul a prodali kupn\u00ed smlouvu jin\u00fdm osob\u00e1m &#8211; to m\u016f\u017ee zkomplikovat p\u0159evod.<\/p>\n\n<p class=\"wp-block-paragraph\">\ud83d\udca1 Z\u00e1sadn\u00ed je pr\u00e1vn\u00ed prov\u011brka &#8211; pr\u00e1vn\u00edk ov\u011b\u0159uje, zda je projekt v bezpe\u010dn\u00e9m stavu, a chr\u00e1n\u00ed klienta prost\u0159ednictv\u00edm <strong>kupn\u00ed smlouvy registrovan\u00e9 v katastru nemovitost\u00ed<\/strong>.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<p class=\"wp-block-paragraph\">7\ufe0f\u20e3 <strong>Poplatky za vyd\u00e1n\u00ed a p\u0159evod pozemk\u016f a geod\u00e9zie<\/strong> a obsahuje:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>\u010d\u00edslo parcely,<\/li>\n\n\n\n<li>popis nemovitosti (byt, d\u016fm, pozemek),<\/li>\n\n\n\n<li>plocha\/velikost,<\/li>\n\n\n\n<li>jm\u00e9no majitele,<\/li>\n\n\n\n<li>datum p\u0159evodu,<\/li>\n\n\n\n<li>registra\u010dn\u00ed \u010d\u00edslo,<\/li>\n\n\n\n<li>p\u0159\u00edpadn\u00e1 v\u011bcn\u00e1 b\u0159emena (hypot\u00e9ka, z\u00e1stavn\u00ed pr\u00e1vo, v\u011bcn\u00e9 b\u0159emeno).<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">\ud83d\udca1 Kupuj\u00edc\u00ed by m\u011bl origin\u00e1l nebo ov\u011b\u0159enou kopii uschovat na bezpe\u010dn\u00e9m m\u00edst\u011b.<\/p>\n\n<hr r\u016fzn\u00e9 typy vlastnick\u00fdch titul\u016f (tureck\u00fd, v\u00fdm\u011bnn\u00fd, tahsis), kter\u00e9 <strong>nemaj\u00ed<\/strong> v r\u00e1mci EU stejn\u00fd pr\u00e1vn\u00ed
