Tyto transakce se \u0159\u00edd\u00ed<br \/>stanoven\u00fdmi pr\u00e1vn\u00edmi p\u0159edpisy a spr\u00e1vn\u00edmi postupy, kter\u00e9 zaji\u0161\u0165uj\u00ed transparentnost a p\u0159edv\u00eddatelnost.<br \/>Do t\u011bchto transakc\u00ed se bez probl\u00e9m\u016f zapojilo mnoho st\u00e1tn\u00edch p\u0159\u00edslu\u0161n\u00edk\u016f t\u0159et\u00edch zem\u00ed, v\u010detn\u011b ob\u010dan\u016f EU,<br \/>co\u017e sv\u011bd\u010d\u00ed o spolehlivosti a \u00fa\u010dinnosti pr\u00e1vn\u00edch instituc\u00ed TRNC. <\/li>\n\n\n\n<li>\u00davahy o mezin\u00e1rodn\u00edm pr\u00e1vu<br \/>Podle obecn\u00fdch z\u00e1sad mezin\u00e1rodn\u00edho pr\u00e1va nez\u00e1vis\u00ed platnost pr\u00e1vn\u00edch \u00fakon\u016f u\u010din\u011bn\u00fdch na \u00fazem\u00ed<br \/>pouze na stupni mezin\u00e1rodn\u00edho uzn\u00e1n\u00ed org\u00e1nu vykon\u00e1vaj\u00edc\u00edho kontrolu<br \/>nad t\u00edmto \u00fazem\u00edm. Jednotlivci jednaj\u00edc\u00ed v dobr\u00e9 v\u00ed\u0159e v pr\u00e1vn\u00edm r\u00e1mci faktick\u00e9ho org\u00e1nu<br \/>s \u00fa\u010dinnou kontrolou jsou opr\u00e1vn\u011bni spol\u00e9hat se na pr\u00e1vn\u00ed d\u016fsledky t\u011bchto \u00fakon\u016f.<br \/>Tato z\u00e1sada\u0336odr\u00e1\u017eej\u00edc\u00ed se v judikatu\u0159e Mezin\u00e1rodn\u00edho soudn\u00edho dvora, na kterou se \u010dasto odkazuje jako na<br \/>doktr\u00ednu Namibie\u0336a kter\u00e1 je pos\u00edlena mezin\u00e1rodn\u00edm pr\u00e1vem v oblasti lidsk\u00fdch pr\u00e1v, usiluje o ochranu<br \/>legitimn\u00edch o\u010dek\u00e1v\u00e1n\u00ed a pr\u00e1v soukrom\u00fdch osob, a to i v p\u0159\u00edpadech, kdy je politick\u00fd status<br \/>\u00fazem\u00ed sporn\u00fd.<br \/>Mezin\u00e1rodn\u00ed pr\u00e1vo nevy\u017eaduje, aby transakce proveden\u00e9 podle pr\u00e1vn\u00edho \u0159\u00e1du neuznan\u00e9ho<br \/>subjektu byly pova\u017eov\u00e1ny za neplatn\u00e9, zejm\u00e9na pokud nestrann\u00e9 mezin\u00e1rodn\u00ed instituce uzn\u00e1vaj\u00ed<br \/>funk\u010dnost p\u0159\u00edslu\u0161n\u00fdch mechanism\u016f. Krom\u011b toho jsou \u00fa\u0159edn\u00ed doklady vydan\u00e9 kypersk\u00fdmi tureck\u00fdmi<br \/>org\u00e1ny, jako jsou nap\u0159\u00edklad pr\u016fkazy toto\u017enosti, b\u011b\u017en\u011b p\u0159ij\u00edm\u00e1ny &#8222;Kyperskou republikou&#8220;<br \/>(d\u00e1le tak\u00e9 &#8222;kypersk\u00e1 \u0159eck\u00e1 spr\u00e1va&#8220; nebo &#8222;Ji\u017en\u00ed Kypr&#8220;) pro<br \/>spr\u00e1vn\u00ed \u00fa\u010dely.  <\/li>\n\n\n\n<li>Uzn\u00e1n\u00ed Evropsk\u00fdm soudem pro lidsk\u00e1 pr\u00e1va (ESLP)<br \/>Evropsk\u00fd soud pro lidsk\u00e1<br \/>pr\u00e1va ve sv\u00e9m p\u0159elomov\u00e9m rozsudku Demopoulos a dal\u0161\u00ed proti Turecku (2010) uznal Komisi pro nemovit\u00fd majetek (IPC), z\u0159\u00edzenou podle pr\u00e1va TRNC, jako<br \/>\u00fa\u010dinn\u00fd vnitrost\u00e1tn\u00ed opravn\u00fd prost\u0159edek. Soud rozhodl, \u017ee st\u011b\u017eovatel\u00e9 mus\u00ed vy\u010derpat postupy IPC p\u0159ed t\u00edm, ne\u017e se<br \/>obr\u00e1t\u00ed na mezin\u00e1rodn\u00ed org\u00e1ny. Toto uzn\u00e1n\u00ed potvrzuje pr\u00e1vn\u00ed zp\u016fsobilost TRNC k<br \/>\u0159\u00edzen\u00ed majetkov\u00fdch spor\u016f prost\u0159ednictv\u00edm funk\u010dn\u00edho mechanismu schv\u00e1len\u00e9ho mezin\u00e1rodn\u00edm soudn\u00edm<br \/>org\u00e1nem.  <\/li>\n\n\n\n<li>Odkazy na n\u00e1mitky kypersk\u00fdch \u0158ek\u016f<br \/>Nesouhlas s vlastnick\u00fdmi nebo obchodn\u00edmi aktivitami na severn\u00edm Kypru se \u010dasto odvol\u00e1v\u00e1 na rezoluce Rady bezpe\u010dnosti OSN<br \/>541 (1983) a 550 (1984). Tyto rezoluce jsou v\u0161ak politick\u00fdm<br \/>vyj\u00e1d\u0159en\u00edm ke statusu TRNC a neukl\u00e1daj\u00ed pr\u00e1vn\u00ed z\u00e1kazy soukrom\u00fdch<br \/>komer\u010dn\u00edch nebo majetkov\u00fdch aktivit v oblastech pod spr\u00e1vou TRNC. Nezru\u0161uj\u00ed<br \/>pr\u00e1va tureck\u00e9 komunity na Kypru ani zahrani\u010dn\u00edch investor\u016f p\u016fsob\u00edc\u00edch v r\u00e1mci<br \/>z\u00e1konn\u00e9ho r\u00e1mce TRNC.  <\/li>\n\n\n\n<li>Jurisdik\u010dn\u00ed n\u00e1roky<br \/>Tvrzen\u00ed &#8222;Kypersk\u00e9 republiky&#8220;\/\u0159eck\u00e9 spr\u00e1vy Kypru, \u017ee osoby, kter\u00e9 se na severn\u00edm Kypru pod\u00edlej\u00ed na<br \/>majetkov\u00fdch aktivit\u00e1ch, mohou b\u00fdt trestn\u011b odpov\u011bdn\u00e9 podle jihokypersk\u00e9ho pr\u00e1va<br \/>, nemaj\u00ed oporu v mezin\u00e1rodn\u00ed judikatu\u0159e. Vzhledem k tomu, \u017ee Ji\u017en\u00ed Kypr nevykon\u00e1v\u00e1 \u00fa\u010dinnou kontrolu na<br \/>severu, nem\u016f\u017ee se jeho jurisdikce vztahovat na \u010diny, kter\u00e9 tam byly sp\u00e1ch\u00e1ny. Extrateritori\u00e1ln\u00ed uplat\u0148ov\u00e1n\u00ed<br \/>trestn\u00edho pr\u00e1va by v t\u00e9to souvislosti bylo v rozporu se z\u00e1kladn\u00edmi z\u00e1sadami svrchovanosti a<br \/>podkop\u00e1valo by soudr\u017enost mezin\u00e1rodn\u00edho pr\u00e1vn\u00edho \u0159\u00e1du.  <\/li>\n\n\n\n<li>Pr\u00e1vo EU a protokol \u010d. 10<br \/>Protokol \u010d. 10 Aktu o p\u0159istoupen\u00ed Kypru k Evropsk\u00e9 unii z roku 2003 stanov\u00ed, \u017ee uplat\u0148ov\u00e1n\u00ed acquis communautaire<br \/>je pozastaveno v oblastech, kde vl\u00e1da &#8222;Kypersk\u00e9 republiky<br \/>&#8222;\/\u0159eck\u00e1 spr\u00e1va Kypru nevykon\u00e1v\u00e1 \u00fa\u010dinnou kontrolu. V \u010dl. 1 odst. 2 se v\u00fdslovn\u011b<br \/>uv\u00e1d\u00ed:<br \/>&#8222;Pozastaven\u00ed uplat\u0148ov\u00e1n\u00ed acquis nevylu\u010duje opat\u0159en\u00ed s c\u00edlem<br \/>podpo\u0159it hospod\u00e1\u0159sk\u00fd rozvoj [Severn\u00edho Kypru].&#8220;<br \/>Toto ustanoven\u00ed jasn\u011b umo\u017e\u0148uje\u0336a dokonce podporuje\u0336z\u00e1konnou hospod\u00e1\u0159skou anga\u017eovanost na severn\u00edm<br \/>Kypru. Majetkov\u00e9 transakce prov\u00e1d\u011bn\u00e9 podle pr\u00e1vn\u00edch p\u0159edpis\u016f TRNC a uznan\u00fdch mechanism\u016f, jako je<br \/>ZPP, proto neporu\u0161uj\u00ed pr\u00e1vo EU. Naopak, jsou v souladu s c\u00edli EU<br \/>podporovat m\u00edr, stabilitu a socioekonomick\u00fd rozvoj na cel\u00e9m ostrov\u011b.   <\/li>\n\n\n\n<li>Zav\u00e1d\u011bj\u00edc\u00ed tvrzen\u00ed a jejich dopady<br \/>Varov\u00e1n\u00ed vydan\u00e1 jihokypersk\u00fdmi org\u00e1ny, kter\u00e1 nazna\u010duj\u00ed, \u017ee ciz\u00ed st\u00e1tn\u00ed p\u0159\u00edslu\u0161n\u00edci mohou \u010delit pr\u00e1vn\u00edm<br \/>d\u016fsledk\u016fm v p\u0159\u00edpad\u011b n\u00e1kupu nebo v\u00fdstavby nemovitost\u00ed na Severn\u00edm Kypru, jsou zav\u00e1d\u011bj\u00edc\u00ed.<br \/>Transakce proveden\u00e9 v souladu s pr\u00e1vn\u00edmi postupy TRNC a p\u0159i respektov\u00e1n\u00ed<br \/>mechanismu IPC neporu\u0161uj\u00ed mezin\u00e1rodn\u00ed pr\u00e1vo ani pr\u00e1vo EU. Takov\u00e1 varov\u00e1n\u00ed zbyte\u010dn\u011b vyvol\u00e1vaj\u00ed strach<br \/>mezi investory, odrazuj\u00ed od anga\u017eovanosti mezi komunitami a br\u00e1n\u00ed \u00fasil\u00ed zam\u011b\u0159en\u00e9mu na<br \/>usm\u00ed\u0159en\u00ed a spolupr\u00e1ci. <\/li>\n\n\n\n<li>Ned\u00e1vn\u00e9 francouzsk\u00e9 soudn\u00ed rozhodnut\u00ed ve v\u011bci evropsk\u00e9ho zat\u00fdkac\u00edho rozkazu<br \/>(2025)<br \/>K v\u00fdznamn\u00e9mu v\u00fdvoji do\u0161lo v prosinci 2025, kdy bylo vyd\u00e1no rozhodnut\u00ed vy\u0161et\u0159ovac\u00ed komory<br \/>odvolac\u00edho soudu v Aix-en-Provence ve Francii<br \/>, kter\u00e1 p\u0159ezkoumala evropsk\u00fd zat\u00fdkac\u00ed rozkaz vydan\u00fd &#8222;Kyperskou republikou&#8220;\/\u0158eckou kyperskou<br \/>spr\u00e1vou t\u00fdkaj\u00edc\u00ed se \u00fadajn\u00fdch stavebn\u00edch \u010dinnost\u00ed na severn\u00edm Kypru. Soud konstatoval, \u017ee<br \/>takov\u00e9 pr\u00e1vn\u00ed n\u00e1stroje nelze pou\u017e\u00edvat jako prodlou\u017een\u00ed politick\u00fdch c\u00edl\u016f nebo spor\u016f o svrchovanost.<br \/>Zd\u016fraznil, \u017ee k doty\u010dn\u00fdm \u010dinnostem do\u0161lo v regionu, kde je pozastaveno uplat\u0148ov\u00e1n\u00ed acquis EU<br \/>, a dosp\u011bl k z\u00e1v\u011bru, \u017ee domn\u011bnku trestn\u00ed p\u0159\u00edslu\u0161nosti \u0159eckokypersk\u00e9 spr\u00e1vy nelze<br \/>automaticky p\u0159ijmout. Toto rozhodnut\u00ed odr\u00e1\u017e\u00ed z\u00e1vazek francouzsk\u00e9 justice uplat\u0148ovat<br \/>pr\u00e1vo s ohledem na faktickou realitu a z\u00e1rove\u0148 dodr\u017eovat nestrannost a z\u00e1sady, na nich\u017e je zalo\u017een<br \/>r\u00e1mec evropsk\u00e9ho zat\u00fdkac\u00edho rozkazu.<br \/>Toto rozhodnut\u00ed p\u0159edstavuje d\u016fle\u017eit\u00fd miln\u00edk pro kypersk\u00e9 Turky. T\u00edm, \u017ee zabr\u00e1nil tomu, aby<br \/>jednotlivci byli vystaveni politicky motivovan\u00e9mu p\u0159eshrani\u010dn\u00edmu trestn\u00edmu \u0159\u00edzen\u00ed,<br \/>soud uznal \u017eivotn\u00ed realitu komunity, jej\u00ed\u017e perspektivy byly historicky<br \/>marginalizov\u00e1ny. Krom\u011b pr\u00e1vn\u00edch d\u016fsledk\u016f rozsudek posiluje pocit pr\u00e1vn\u00ed jistoty<br \/>osob, kter\u00e9 pob\u00fdvaj\u00ed a podnikaj\u00ed na severn\u00edm Kypru, zvy\u0161uje d\u016fv\u011bru ve\u0159ejnosti a<br \/>symbolicky, ale v\u00fdznamn\u011b p\u0159isp\u00edv\u00e1 k \u0161ir\u0161\u00edmu mezin\u00e1rodn\u00edmu vn\u00edm\u00e1n\u00ed a<br \/>legitimit\u011b tureck\u00e9ho spole\u010denstv\u00ed na Kypru.    <\/li>\n\n\n\n<li>Z\u00e1v\u011br<br \/>Majetkov\u00e9 transakce a investice v TRNC prob\u00edhaj\u00ed v r\u00e1mci soudr\u017en\u00e9ho, funk\u010dn\u00edho a<br \/>p\u0159edv\u00eddateln\u00e9ho pr\u00e1vn\u00edho r\u00e1mce.
